a) Contract and Communication

Your contract for the holiday services is with vicfallsadventures ("the Company"), registered in Zimbabwe. All bookings are subject to the terms and conditions set forth.

b) Booking Form and Deposit

All communications regarding your booking will be sent to the address provided on your booking form. Bookings must be made through an authorized representative of the Company. At the time of booking, you must complete and submit the Company booking form along with a deposit of 50% of the total cost.

c) Confirmation and Refusal

The receipt of your deposit and booking form does not guarantee confirmation. Your booking is only confirmed upon receipt of a written confirmation from the Company. The Company reserves the right to refuse any booking and will return any deposits in such cases.

d) Full Payment and Responsibility

Full payment for your holiday is required at least 30 days prior to departure. Failure to make full payment by the due date may result in the cancellation of your booking, with the Company retaining the deposit. The person who signs the booking form guarantees full payment in accordance with these terms. It is the responsibility of the signatory to ensure timely payment; no reminders will be issued.

e) Late Bookings

Bookings made within 30 days of departure require full payment at the time of booking.

f) Special Requests

Special requests, such as dietary requirements, should be noted on the booking form.

g) Service Provision

The Company will provide the services as outlined and confirmed in writing.

a) Cost Breakdown

The Company is not obligated to provide a breakdown of the holiday costs.

b) Price Increase Notification

The Company reserves the right to inform you of any price increase before accepting your booking.

c) Surcharges

After the issuance of a Confirmation Invoice, unless full payment is made at the time of booking, the price may be subject to surcharges in certain circumstances. Surcharges may arise due to increases in transportation costs, fuel, airfares, taxes, or changes in exchange rates. The Company will absorb the first 2% of any surcharge. Only amounts exceeding this 2% will be passed on to you. Revised invoices will be issued to notify you of any surcharges.

d) Surcharge Cancellation

If a surcharge increases the total holiday price by 10% or more, you may cancel your booking within 14 days of the revised invoice’s issuance and receive a full refund of payments made to the Company.

e) Full Payment Option

You may opt to pay for your holiday in full at the time of booking to lock in the quoted price. To qualify, return the Confirmation Invoice with full payment within 7 days of its date.

f) Price Reduction

The Company cannot reduce prices if the value of the Zimbabwean bond strengthens.

a) Changes and Major Changes

The Company reserves the right to make changes to your holiday. If significant changes are necessary, and they are not due to circumstances beyond the Company’s control, you may (i) accept the changes, (ii) choose another holiday, or (iii) cancel your booking. Compensation may be available for major changes.

b) Minor Changes

No compensation will be offered for minor changes, such as alterations to departure times or accommodation changes to a comparable or superior standard.

c) Major Changes

Major changes include cancellations, changes to your airport, delays exceeding 12 hours, or accommodation changes to an inferior standard.

d) Force Majeure

Compensation will not be provided for changes or cancellations caused by Force Majeure events, including natural disasters, war, terrorism, or other unforeseen events. Adequate travel insurance is recommended.

e) Cancellation by Company

The Company reserves the right to cancel your holiday at any time before departure. In such cases, a full refund of payments made will be issued, but no compensation will be provided.

f) Transportation Conditions

Transportation is subject to the carrier’s conditions of carriage, which may limit or exclude liability. These conditions are usually detailed on the carrier’s tickets.

g) Non-Payment

Failure to pay the balance at least 30 days before departure will result in the booking being treated as cancelled, with applicable cancellation charges applied.

h) Refusal of Tour Participation

The Company reserves the right to refuse any individual from participating in the tour if their presence could compromise the safety and enjoyment of others. In such cases, the Company’s liability is limited to a refund of payments made, minus any costs for services used and administrative fees.

Clients are permitted one free set of amendments to the itinerary. Any additional changes will incur a fee of 25 Omani Rials to cover communication and administration costs, in addition to any extra costs incurred for modifications, including airline and hotel changes.

a) Facilities and Liability

The Company does not own or manage the facilities used during your tour, including aircraft, accommodation, and restaurants. While care is taken in selecting these providers, we do not inspect or warrant their quality.

b) Liability for Incidents

The Company is not liable for any death, illness, or injury resulting from failures in the contract attributable to the actions of the party, third parties, or unforeseen events.

c) Activities Outside of Arrangement

The Company cannot accept liability for illness, injury, or death arising from activities not included in the holiday arrangement. We will offer general assistance where appropriate.

d) Unused Tickets

Refunds will not be issued for unused tickets unless a refund can be obtained from the provider.

a) Travel Insurance

You must arrange your own travel insurance, although policies can be included in your tour package. All insurance details must be provided on the booking form, and bookings will not be accepted without proof of insurance.

b) Documentation

Ensure that all party members have valid passports, visas, and necessary documentation. The Company is not responsible for delays or expenses due to issues with documentation.

c) Check-In and Attendance

You are responsible for timely check-in and attendance at all booked components of your holiday. The Company is not liable for missed flights or components due to late check-ins, and no refunds will be provided for lost or damaged travel documents.

d) Behavior

By booking, you agree to behave responsibly and not disrupt the enjoyment of others or damage the Company’s reputation. Failure to comply may result in immediate termination of your holiday with no further obligations from the Company.

e) Medical Conditions

The person signing the booking form must disclose any pre-existing medical conditions of the party members.

f) Personal Equipment

Personal equipment and effects are at your own risk. The Company is not responsible for loss, damage, or delay to your luggage or belongings unless caused by our negligence.

Smoking is prohibited in any vehicle operated by the Company. Frequent stops can be arranged for smokers. Accommodation will be reserved with non-smoking rooms unless specifically requested otherwise, subject to availability.

The Company will ensure safety during the tour but acknowledges that certain activities may involve risks. Clients will be required to sign a 'Waiver of Responsibility' form acknowledging these risks and agreeing to exercise caution.

The Company has made reasonable efforts to ensure the accuracy of information on our website. However, we accept no responsibility for any errors or omissions.

If issues arise during your holiday, inform the relevant service provider immediately. If unresolved, contact the Company office for assistance. Complaints should be submitted in writing within 28 days of returning home. Failure to do so may affect your ability to receive compensation. Disputes will be governed by Zimbabwean law.

The Company may request personal information, such as dietary needs or medical conditions. This information is confidential and used only to fulfill the contract. You can inspect this information during business hours and it will be shared with suppliers as necessary.
